Terms of Service

1. Who we are

BeatIQ is operated by Sergey Rybchinskiy, an individual developer based in Georgia. Contact: support@beatiq.net.

2. What BeatIQ does

BeatIQ does two things for a music producer. It reads your own BeatStars campaign and sales records and turns them into analytics: what you spent on promotion, what it earned, and how that changed over time. And it turns your tracks into videos and publishes them to a YouTube channel you connect, with the title, description, tags and schedule you approve before anything is uploaded.

For the analytics you need both a BeatIQ account and a BeatStars producer account, connected through our Chrome extension. For publishing you need a YouTube channel connected through Google's consent screen. Either part can be used without the other.

3. Eligibility, and the account you connect

• You must be at least 16 years old and able to enter into a contract.
• You may only connect a BeatStars account that you own, or that you are authorised to manage. Connecting someone else's account without their permission is a breach of these terms and we will terminate your access for it.
• You are responsible for keeping your BeatIQ password secure and for what happens under your account.

4. What you may not do

• Resell, redistribute or publish data obtained through BeatIQ, including data about other producers or about people who buy from you.
• Use BeatIQ to contact, market to or profile the people who buy from you in a way that breaks the law that applies to them.
• Attempt to access another user's data, probe or disrupt our systems, or work around limits on your plan.
• Reverse engineer the service, except where the law expressly allows it.
• Use BeatIQ to break BeatStars' own terms of service.

5. Your content and your data

Your beats, your catalogue and your sales records remain yours. You grant us only the permission needed to operate the service for you: to read that data from BeatStars using your connection, store it, process it and display it back to you. How we handle personal data is described in our Privacy Policy, which forms part of these terms.

6. Paid plans

• Some features require a paid plan. Prices and what each plan includes are shown before you subscribe.
• Subscriptions are billed through PayPal and renew automatically until you cancel.
• You can cancel at any time. Cancelling stops the next renewal; it does not refund the period you are already in.
• If a payment fails, we may suspend paid features until it is settled.
• If we change prices, we will tell you before the change applies to your subscription.

7. BeatStars and other third parties

BeatIQ depends on BeatStars continuing to make your data available to you. If BeatStars changes or restricts that access, some BeatIQ features may stop working, in whole or in part, and that is outside our control. The same applies to the other providers listed in our Privacy Policy.

8. YouTube API Services

The publishing part of BeatIQ uses YouTube API Services. By connecting a channel you also agree to the YouTube Terms of Service, and Google's handling of the data it receives is governed by the Google Privacy Policy.

• You may only connect a YouTube channel that you own, or that you are authorised to manage. The access you grant is used solely to publish and manage videos on that channel, on your instruction.
• We do not use YouTube API Services to read channels you have not connected, to search YouTube, or to collect data about other creators.
• You can revoke our access at any time. Disconnecting a channel in BeatIQ revokes the token with Google immediately and deletes the stored authorisation on our side. You can also revoke it yourself at Google security settings.
• Data obtained from YouTube API Services is refreshed or deleted within 30 days, except where we are required to keep it longer.
• A video published through BeatIQ is your content and your responsibility. You must have the rights to the audio and the artwork you upload, and the upload must comply with YouTube's own policies.

9. Availability, and changes to the service

We work to keep BeatIQ available and accurate, but we do not promise uninterrupted service. We may add, change or remove features. If we remove something you rely on and you are on a paid plan, you may cancel and we will refund the unused part of your current period.

10. Accuracy of analytics

BeatIQ reports figures derived from what BeatStars gives us, and applies our own methods for attributing sales to promotion. Those figures are an aid to your judgement, not a guarantee. They may be incomplete or delayed, and BeatStars may revise its own numbers after we have read them. Business and spending decisions are yours.

11. Disclaimers and limits

To the extent the law allows, BeatIQ is provided "as is", without warranties of any kind. We are not liable for lost profits, lost revenue, lost data or indirect or consequential losses. Where liability cannot be excluded, our total liability to you is limited to what you paid us in the twelve months before the claim arose. Nothing here limits liability for fraud, or for anything else that cannot lawfully be limited.

12. Ending your access

You may stop using BeatIQ at any time, disconnect BeatStars from the extension, or delete your account. We may suspend or terminate an account that breaches these terms, that is used unlawfully, or that puts the service or other users at risk. When your account is deleted, we handle your data as described in the Privacy Policy.

13. Changes to these terms

We may update these terms. If a change materially affects you, we will tell you before it takes effect. Continuing to use BeatIQ after that means you accept the updated terms.

14. Governing law

These terms are governed by the laws of Georgia, and the courts of Georgia have jurisdiction, without affecting any consumer protection rights you have where you live.
